These Terms and Conditions govern the use of Lumivara's website and the services provided by Lumivara at 52/1 Moo 3, Rawai, Mueang Phuket, Phuket 83130, Thailand. By accessing our website or enquiring about our services, you confirm that you have read and understood these terms. Please read them carefully before proceeding.
1. Definitions
In these Terms and Conditions, the following terms have the meanings below:
- "Lumivara" / "We" / "Us" / "Our" — the residential care facility operating at 52/1 Moo 3, Rawai, Mueang Phuket, Phuket 83130, Thailand.
- "Service" — the Social Day Program, Residential Comfort, Intensive Care Residence programmes, and any related care or support activities provided by Lumivara.
- "User" / "You" — any person visiting our website, submitting an enquiry, or entering into a care arrangement with Lumivara.
- "Resident" — an individual receiving care or attending a programme at the Lumivara facility.
- "Agreement" — the care service agreement signed between Lumivara and the responsible family member or legal representative of a Resident.
2. Acceptance of Terms
By using this website or engaging with our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. Use of the website constitutes acceptance of these Terms and Conditions in their current form. If you do not accept these terms, please do not use the website or contact us to proceed with a service enquiry.
3. Service Description
Lumivara provides residential and day care services for older adults, across three distinct programmes:
- Social Day Program — structured daytime activities and social engagement for seniors living at home.
- Residential Comfort — full-time residential care with personal support, meals, and activities.
- Intensive Care Residence — comprehensive care including 24-hour nursing, rehabilitation, and specialist coordination.
Services are provided at our Rawai, Phuket facility. Availability of places in each programme is subject to capacity and assessment. Lumivara reserves the right to determine the most appropriate care level for each individual following an initial assessment.
4. Enquiries and Admissions
Submission of an enquiry through our website does not constitute a binding agreement or reservation of a care place. A formal care arrangement is only in effect upon execution of a written Agreement by both parties. Lumivara may conduct an assessment prior to confirming admission.
5. User Responsibilities
Users of this website agree to:
- Provide accurate and complete information when submitting enquiries or entering into an Agreement
- Not use the website for any unlawful purpose or in a way that may cause harm to Lumivara or third parties
- Not reproduce, distribute, or republish content from this website without written permission
- Respect the privacy and dignity of all residents and staff when visiting the facility
6. Intellectual Property
All content on this website — including text, design elements, images, and structure — is the property of Lumivara or is used with appropriate permissions. You are granted a limited, non-exclusive licence to view this content for personal, non-commercial purposes only. No content may be copied, adapted, or redistributed without prior written consent from Lumivara.
7. Payment Terms
Fees for each care programme are stated in Thai Baht (THB). Full fee details, payment schedules, and invoicing arrangements are set out in the written Agreement. Monthly fees are due in advance as specified in the Agreement. Lumivara will provide written notice of any fee changes with a minimum of 30 days' advance notice.
Fees for additional services not included within the standard programme tier — such as specialist consultations or physiotherapy — will be agreed in writing before those services are provided and invoiced separately.
8. Withdrawal and Refund Policy
Notice periods and refund terms for programme withdrawal are set out in the individual care Agreement. In general, Lumivara requires a minimum of 30 days' written notice for programme withdrawal or termination. Fees paid in advance for the notice period will be reconciled in accordance with the Agreement terms. Any exceptions are addressed on a case-by-case basis.
9. Disclaimers
Lumivara provides care services to the best of its professional ability. However, we do not make representations as to specific health outcomes or rates of improvement for any individual. Care needs and outcomes vary, and Lumivara's services are not a substitute for emergency medical treatment or specialist hospital care when such is required.
Website content is provided for informational purposes. While we aim to keep it accurate and current, we cannot warrant that information is always complete or error-free.
10. Limitation of Liability
To the extent permitted by Thai law, Lumivara's liability for any claim arising from the use of this website or from the provision of services shall be limited to the direct losses arising from the specific incident giving rise to the claim. Lumivara shall not be liable for indirect, incidental, or consequential losses. Nothing in these terms excludes liability for personal injury caused by negligence.
11. Termination
Either party may terminate a care arrangement in accordance with the notice provisions in the written Agreement. Lumivara may terminate a care arrangement with immediate effect in circumstances where continuing the arrangement would pose a risk to the Resident, other residents, or staff, or where material obligations under the Agreement have not been met. In such cases, Lumivara will endeavour to support an appropriate transition of care.
12. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through good-faith discussion in the first instance. If a resolution cannot be reached informally within 30 days, either party may refer the matter to mediation or, if necessary, to the courts of Thailand. These Terms and Conditions are governed by and interpreted in accordance with the laws of the Kingdom of Thailand.
13. General Provisions
- Entire agreement: These Terms and Conditions, together with any written care Agreement, constitute the full agreement between the parties.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce a provision on one occasion does not constitute a waiver of the right to enforce it on another.
- Assignment: You may not assign your rights under any Agreement without Lumivara's written consent.
14. Changes to These Terms
Lumivara may update these Terms and Conditions from time to time. The revised version will be published on this page with an updated effective date. For existing care Agreements, material changes will be communicated directly in writing with reasonable notice.
